Digital Lemon Talent – Standard Terms and Conditions of Business (Permanent Recruitment)

These Terms and Conditions (“Terms”) apply to all permanent recruitment services provided by Digital Lemon Talent (“the Agency”) to the client (“the Client”). By instructing the Agency to source candidates the Client is deemed to have accepted these Terms.

 

1. Introduction

Digital Lemon Talent acts as an employment agency in accordance with the Employment Agencies Act 1973. These Terms govern all introductions of candidates made by the Agency to the Client.

 

2. Fees

A fee of 15% of the candidate’s first year’s gross annual remuneration is payable upon the candidate’s acceptance of an offer of employment.

Gross annual remuneration includes basic salary only. 

 

3. Payment Terms

Invoices are issued on the candidate’s acceptance of an offer.
Payment is due within 30 days of the invoice date.

Late payments may result in the withdrawal of any rebate entitlement.

 

4. Rebate Structure

If a candidate leaves their role within the first 12 weeks of employment the Client may be entitled to a rebate, provided:

  • The invoice has been paid in full within the 30 day payment terms

  • The Agency is notified in writing within 48 hours of the candidate leaving

  • The departure is not due to redundancy, restructuring or significant changes to the role, salary or working conditions

Rebate Schedule:

  • 0–4 weeks: 100% rebate

  • 5–8 weeks: 50% rebate

  • 9–12 weeks: 25% rebate

No rebate applies after 12 weeks.

 

5. Introductions

All candidate information is confidential. If the Client passes candidate details to a third party and that third party hires the candidate, the Client is liable for the full fee.

Introductions remain valid for 12 months from the date of introduction.

 

6. Client Responsibilities

The Client is responsible for:

  • Providing accurate job information

  • Ensuring compliance with employment law

  • Conducting interviews, reference checks and verifying the candidate’s right to work

The Agency accepts no liability for decisions made by the Client regarding hiring.

 

7. Liability

The Agency will use reasonable skill and care in sourcing candidates but does not guarantee suitability. The Agency is not liable for loss, damage or costs arising from the employment of a candidate.

 

8. Governing Law

These Terms are governed by the laws of England and Wales.
